Terms of Service.

The terms governing your use of AI360° Network's website, free audit, SMS messaging program, and any services we provide.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website at ai360network.com and any related services, content, products, or communications (collectively, the "Services") provided by AI360° Network, operated by TMG Consulting LLC, a Texas limited-liability company with offices at 5850 San Felipe #500, Houston, TX 77057 ("AI360°," "we," "us," "our").

By accessing the Services, submitting any form, opting into our SMS messaging program, or otherwise interacting with us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. Description of Services

AI360° Network builds operational systems for service-based businesses — including CRM setup, automation, AI agents, voice AI, lead generation, follow-up sequences, websites, and related infrastructure. Through our website, we offer:

  • A free 30-minute "AI Audit" of a prospective client's existing systems, delivered as a written punch-list and 90-day roadmap.
  • Educational content (blog, glossary, comparisons, case studies, resources).
  • Optional SMS, email, and phone communications when you opt in.
  • Custom-engagement services (CRM builds, automation, AI deployments) under separate written engagement agreements.

3. Eligibility

You must be at least 18 years of age and the account holder or an authorized user of any phone number, email address, or other contact method you submit to us. By using the Services, you represent and warrant that you meet these requirements.

4. Free AI Audit Disclaimer

The free AI Audit is informational. Recommendations are based on the information you provide and AI360°'s general business judgment. The audit does not constitute legal, financial, tax, or accounting advice. Implementation of any recommendations is at your discretion and risk. AI360° makes no guarantee of specific business outcomes from the audit. Any engagement to implement recommendations will require a separate written agreement.

5. SMS / Text Messaging Program

Program name: AI360° Network SMS — transactional and (optional) marketing notifications related to your free audit, scheduling, follow-up, and (with separate consent) promotional updates.

5.1 How you opt in

By submitting our free audit form or any other web form on our website that includes an unchecked, optional SMS-consent checkbox, and by checking that box, you expressly consent to receive recurring SMS and MMS messages from AI360° Network at the phone number you provide.

5.2 Message types

Transactional messages include audit booking confirmations, calendar reminders, follow-up scheduling, intake form completion, and audit-finding delivery notifications. Marketing messages (only if you opt in separately) may include service announcements, content drops, event invitations, and promotional offers.

5.3 Message frequency

Message frequency varies based on your engagement, typically up to 8 messages per month.

5.4 Message and data rates

Message and data rates may apply for messages sent to you from us and to us from you. Standard carrier rates apply.

5.5 Carrier disclaimer

Carriers (including but not limited to AT&T, T-Mobile, Verizon, US Cellular, and any participating carriers) are not liable for delayed or undelivered messages.

5.6 Opt-out

To stop receiving SMS messages from us at any time, simply text STOP in reply to any message you receive. Once you text STOP, we will send a confirmation message and you will not receive further marketing SMS from us. Standard transactional messages necessary to deliver requested services may continue if you remain an active client; you can cancel those by emailing errol@ai360network.com.

5.7 Rejoining

If you previously opted out and want to rejoin, sign up as you did initially via our website forms.

5.9 Privacy

Mobile information collected through this program is governed by our Privacy Policy. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

5.10 Compliance

Our SMS practices comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles & Best Practices, and applicable A2P 10DLC carrier requirements administered by The Campaign Registry.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law.
  • Submit false, misleading, or impersonating information through any form.
  • Attempt to gain unauthorized access to any part of the Services, our systems, or our networks.
  • Interfere with, disrupt, or place an unreasonable load on the Services.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without express written permission.
  • Reverse-engineer, decompile, or scrape automated content from our website without permission, except for legitimate AI-crawler indexing as documented in our llms.txt.

7. Intellectual Property

All content on the website — including text, graphics, logos, illustrations, photos, code, and the AI360° brand — is the property of TMG Consulting LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may not use any AI360° trademarks or branding without prior written permission.

Limited license: we grant you a personal, non-exclusive, non-transferable license to access and use the Services for lawful, non-commercial review of our content and to engage our services through normal channels.

8. User Content

If you submit information, ideas, suggestions, or feedback to us (collectively, "Submissions"), you grant AI360° a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate the Submissions for any business purpose, including improving our services. You represent that your Submissions do not infringe the rights of any third party.

9. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, AI360° Network, TMG Consulting LLC, and our owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of your use of the Services. Our total aggregate liability for any claim arising out of or relating to the Services or these Terms is limited to one hundred U.S. dollars ($100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless AI360° Network, TMG Consulting LLC, and our owners, employees, agents, and licensors from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction in those courts.

13. Modifications

We may update these Terms at any time. Material changes will be communicated via a notice on our website or, where appropriate, by email. The "Last updated" date at the top reflects the current version. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Sections 7 (Intellectual Property), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 12 (Governing Law), and any other provisions that by their nature should survive will survive termination.

15. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any separate written engagement agreement between you and AI360°, constitute the entire agreement between you and us regarding the Services.
